General Terms and Conditions of Sale

BIOVITALITI — Consumer Sales — Version of October 6, 2026

1. Seller identity and contact

The site biovitaliti.com is operated under the brand BIOVITALITI by Haykel Mejri, sole trader (EI), hereinafter "BIOVITALITI" or "the seller".

Business and correspondence address: 247 avenue de Grasse, 06400 Cannes, France.

SIREN: 834 033 466. SIRET: 834 033 466 00022.

Customer service email: vitalitibio@gmail.com.

2. Scope and acceptance

These General Terms and Conditions of Sale (T&Cs) govern the purchase of dietary supplements on biovitaliti.com by natural persons acting for purposes outside their professional activity. Orders are delivered in France and Belgium, in the areas offered at the time of ordering.

The customer can view, save, and print the T&Cs before ordering. The applicable version is the one presented at the time of the order. Validation of the order after reading the T&Cs constitutes acceptance thereof. Any subsequent changes do not apply to orders already concluded.

3. Products, availability and precautions for use

The essential characteristics, composition, quantities, usage tips, and precautions appear on the product sheets and the labeling. The customer is invited to read them before purchase and to respect the doses and storage conditions indicated. Illustrations do not negate the characteristics promised on the product sheet.

The products are dietary supplements and do not replace a varied and balanced diet or a healthy lifestyle. They are not intended to diagnose, prevent, treat, or cure any disease. In case of treatment, pregnancy, breastfeeding, or any specific situation, the customer must check the product's precautions and seek advice from a healthcare professional. The products must be kept out of the reach of children.

Products are offered while stocks last. A reference marked "soon available" is not offered for purchase until it is available, unless a pre-order offer is expressly presented with its own deadline. If an unavailability occurs after payment, BIOVITALITI informs the customer and refunds the amounts corresponding to the unavailable products without undue delay. A replacement requires the customer's agreement.

4. Prices and quantity offers

Prices are expressed in euros and correspond to the final amount of the products, excluding delivery costs indicated separately before validation. The seller falls under the VAT base franchise: VAT not applicable, article 293 B of the French General Tax Code. The total amount to be paid, including delivery costs and excluding discounts, is summarized before the order.

The applicable prices are those displayed at the time of the order. Price changes do not affect an already concluded order.

For eligible BIOVITALITI products: an automatic 10% discount applies from two jars; an automatic 15% discount applies from three jars. Different references can be combined. The best eligible discount applies; the 10% and 15% discounts are not cumulative. Free delivery from two jars is cumulative with this discount. The conditions of any other potential offer are indicated before purchase.

5. Ordering and payment

The customer chooses their products and quantities, checks their basket, enters their contact details and address, chooses a delivery method and a payment method from those offered, then checks the summary and corrects any errors. They validate their order using the button expressly signaling an obligation to pay.

The price is payable in full upon ordering, by the means actually offered for payment. Payment processing is provided by the service providers indicated in this process. The order is confirmed by email with its summary and the contractual conditions on a durable medium.

In case of payment failure, the order is not confirmed. In case of proven difficulty regarding an order, particularly an objective suspicion of fraud, BIOVITALITI will contact the customer to resolve it. If a paid order must be canceled for a legitimate reason, the sums collected will be refunded without undue delay.

For available products, the total delivery time is 24 to 48 working hours from order validation and payment, including preparation and shipping. Saturdays, Sundays, and public holidays are not counted. Any geographical restriction or different time frame must be clearly announced before order validation; the time frame expressly accepted in this context applies.

Orders are prepared and shipped from France to the address or pick-up point chosen when ordering. Tracking information is provided when available. In case of an address error, the customer is invited to contact customer service quickly; a correction before shipment is made whenever possible.

The risks of loss or damage are transferred to the customer when they take physical possession of the goods, or when a third party designated by them, other than the carrier, takes possession of them. If the customer chooses a carrier not proposed by BIOVITALITI, the specific legal rules regarding this choice apply.

A damaged package, an error, or a missing product can be reported to customer service, with useful elements such as the order number and photographs. The absence of reservations with the carrier or immediate reporting does not deprive the customer of their legal rights.

In case of delay, the customer may request delivery in writing within a reasonable additional period. If this period is not respected, they may terminate the contract in writing. They may terminate it immediately when the seller refuses delivery, when it is manifest that it will not take place, or when the agreed deadline was an essential condition of the purchase under the conditions provided by law. In the event of termination for non-delivery, all sums paid are refunded at the latest within fourteen days following the termination of the contract, without prejudice to other legal rights of the customer.

7. Right of withdrawal

The customer has fourteen days to notify their withdrawal, without having to justify it. This period runs from the date of receipt of the product by the customer themselves or by a third party designated by them, other than the carrier. For several products in the same order delivered separately, it runs from receipt of the last product. The day of receipt is not counted; if the period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.

The customer can inform BIOVITALITI by using the form provided in the annex, or any unambiguous statement, sent before the expiration of the period to vitalitibio@gmail.com or to the correspondence address in Article 1.

In accordance with Article L. 221-28, 5° of the French Consumer Code, the right of withdrawal does not apply to sealed products that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection. This exception concerns in particular a jar whose lid or safety seal protecting the content has been broken, when such unsealing prevents its return for these reasons. The mere opening of the shipping box does not negate the right of withdrawal. The food nature of the product is not, by itself, sufficient to exclude this right.

This exception is independent of legal guarantees: a defective or non-compliant product remains covered by them, even after opening when it was necessary to observe the defect.

8. Returns and refunds after withdrawal

Products must be returned without undue delay, no later than fourteen days after notification of withdrawal. They must be protected for transport and kept in suitable conditions. When the exception in Article 7 applies, the content protection device must remain intact.

The postal return address is: BIOVITALITI — Haykel Mejri EI, 247 avenue de Grasse, 06400 Cannes, France. The customer is invited to contact vitalitibio@gmail.com to facilitate the identification of the return and to obtain, if they wish, a label organized by BIOVITALITI. This contact does not constitute a prior authorization necessary to exercise the right of withdrawal.

The direct costs of return in case of withdrawal are borne by the customer. For a return with the label proposed by BIOVITALITI, these costs are €3.90 per package; the terms are communicated during the request. If the customer chooses a carrier themselves, they pay that carrier's rate directly. No processing or restocking fee is added. A return made under a legal guarantee is handled by BIOVITALITI.

In case of withdrawal from the entire order, BIOVITALITI refunds the sums paid, including initial standard delivery costs. The supplement related to a more expensive delivery method voluntarily chosen is not refunded. The refund is made without undue delay, no later than fourteen days after receipt of the notification; BIOVITALITI may defer it until recovery of the products or receipt of proof of their shipment, whichever is the earlier.

The refund uses the same payment method as the purchase, unless expressly agreed otherwise by the customer at no cost to them. No credit note may be imposed on them. In case of partial return, the products concerned are refunded at the price actually paid after the discount, without retroactive invoicing of the delivery costs initially offered. Initial delivery costs are refunded up to the share directly attributable to the returned products; a flat-rate delivery charge that remains unchanged for the kept products does not give rise to an additional refund of this flat rate.

A decrease in value resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the product may engage the customer's liability under legal conditions, when they have been duly informed of their right of withdrawal.

9. Legal guarantees

BIOVITALITI is liable for defects of conformity and hidden defects under the conditions provided by the Consumer Code and the Civil Code. The customer contacts the seller at the contact details in Article 1. The costs necessary for implementing the legal guarantee of conformity are borne by the seller.

The legal guarantee covers defects falling under its conditions of application. It does not constitute a two-year consumption shelf-life promise: the date and storage conditions indicated on the label remain applicable. No clause deprives the consumer of the legal rights attached to a lack of conformity existing at the time of delivery.

Legal Box — Annex to Article D. 211-2 of the Consumer Code

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

When the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee applies to this digital content or digital service throughout the entire period of supply provided. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date of its appearance.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to the repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund in exchange for the return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods occurs after a period of thirty days;

3° The repair or replacement of the goods causes a major inconvenience to the consumer, particularly when the consumer permanently bears the costs of recovery or removal of the non-compliant goods, or if they bear the costs of installation of the repaired or replacement goods;

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or termination of the contract when the lack of conformity is so serious that it justifies immediate price reduction or contract termination. The consumer is then not required to request the repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period of immobilization of the goods for repair or replacement suspends the guarantee that remained to run until the delivery of the restored goods.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

The seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or a full refund in exchange for the return of the goods.

10. Liability and personal data

BIOVITALITI remains responsible for the proper execution of the order in accordance with legal provisions, including when delivery is entrusted to a service provider. No provision of the T&Cs limits the seller's liability beyond what the law allows, nor does it exclude legal guarantees or consumer rights.

The data necessary for the order are processed for its management, payment, delivery, customer service, and compliance with legal obligations. The recipients, storage periods, and methods for exercising rights are specified in the privacy policy accessible on the site. Requests can be sent to vitalitibio@gmail.com. The purchase does not require consent to commercial communications when it is required.

11. Complaints and consumer mediation

For any complaint, the customer can write to vitalitibio@gmail.com or the correspondence address indicated in Article 1, specifying the order number and the difficulties encountered.

The consumer benefits from the right to use a consumer mediation system free of charge after a prior written complaint to the seller, under the conditions of Articles L. 612-1 et seq. of the Consumer Code. Mediation is optional and does not remove the right to bring the matter before a court.

12. Applicable law and competent jurisdictions

These T&Cs are subject to French law. For a consumer residing in Belgium, this choice does not deprive them of the protection afforded by the mandatory provisions of the law of their country of habitual residence that would be applicable in the absence of this choice, in accordance with European rules.

In the absence of an amicable solution, the dispute may be brought before the competent courts according to applicable national and European rules. No exclusive jurisdiction of the courts of the seller's headquarters is imposed on the consumer.
